Terms of Service
Last updated: October 17, 2026
These Terms of Service ("Terms") govern your use of the Tracked web application at tracked.quest and the Tracked browser extension (together, the "Service"), operated by Linh Tran, based in Ontario, Canada ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use Tracked
You must be at least 13 years old (or 16 in jurisdictions where that is the minimum, such as the European Union) to use the Service. By using Tracked you represent that you meet this age requirement and that the information you give us when creating an account is accurate.
2. Your account
- You are responsible for keeping your login credentials confidential.
- You are responsible for all activity that happens under your account.
- Notify us immediately at contactlinhttran@gmail.com if you believe your account has been accessed without your permission.
- You may only create one account for your personal use. Do not share your account with others.
3. Your content
Tracked is a tool for you to organize your own job-application information ("Your Content"). You keep all rights to Your Content. We do not claim ownership of anything you put into Tracked.
To actually run the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, back up, and display Your Content, solely so we can show it back to you and sync it between your devices. This licence ends when you delete Your Content or your account, except for backups that normally age out of our hosting providers' systems.
You are responsible for Your Content. Do not upload content that you do not have the right to upload, or content that infringes someone else's rights.
4. Acceptable use
When you use Tracked you agree not to:
- Break any law, or help anyone else break the law.
- Try to access accounts, data, or systems that do not belong to you.
- Reverse engineer, decompile, or try to extract the source code of the Service, except to the limited extent this restriction is prohibited by applicable law.
- Scrape, crawl, or hammer the Service with automated requests that interfere with normal operation.
- Upload malware, run attacks, probe for vulnerabilities, or disrupt the Service for other users.
- Use the Service to spam, harass, defame, impersonate someone, or send unlawful or deceptive messages.
- Resell, sublicense, or commercially exploit the Service without our written permission.
5. The browser extension
When installed, the Tracked browser extension can read the URL and visible text of the tab you are currently viewing only while you have the Tracked popup open, so it can pre-fill the "save job" form. The extension does not read pages in the background, and nothing is sent to our servers until you click "Save Job". You can remove the extension at any time from your browser's extension settings.
The extension is distributed through the Chrome Web Store and other extension stores. Those stores have their own terms that apply to how you install and receive updates.
6. Third-party services
The Service depends on third-party providers (including Supabase for database and authentication, Vercel for web hosting, and Google for optional "Sign in with Google"). Those providers have their own terms of service and privacy policies, and we are not responsible for their acts or omissions. You can see which providers we use, and what data they receive, in our Privacy Policy.
7. Fees
Tracked is currently offered free of charge. If we ever introduce paid features, we will make the price and the billing terms clear before you buy, and you will not be charged for anything you have not agreed to.
8. Our intellectual property
The Tracked name, logo, website, extension, source code, design, and all related intellectual property belong to us. These Terms do not grant you any right to use our branding, trademarks, or copyrighted materials except as needed to use the Service as intended.
9. Service availability and changes
We work to keep Tracked available, but we do not promise that the Service will be uninterrupted, error-free, secure, or free of data loss. We may add, change, suspend, or remove features at any time. We may also suspend or stop offering the Service entirely, with reasonable notice when practical.
10. Suspension and termination
You can stop using Tracked at any time and ask us to delete your account by emailing contactlinhttran@gmail.com.
We may suspend or close your account if you break these Terms, if we are required to by law, or to protect the Service and its users. Where reasonable, we will give you notice first. When your account is closed, your access ends and we will delete Your Content as described in our Privacy Policy.
11. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will meet your requirements, be accurate, be uninterrupted, be timely, be secure, or be free of errors.
Nothing in these Terms excludes or limits any legal rights you have as a consumer under applicable Canadian law, including the Consumer Protection Act, 2002 (Ontario), the Consumer Protection Act (Quebec), and the Civil Code of Québec. Where a warranty, condition, or right cannot legally be excluded, it continues to apply, and nothing in these Terms is intended to override it.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost opportunities, or lost or corrupted data, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for all claims arising out of or related to the Service in any twelve-month period is limited to the greater of (a) the amount you have paid us for the Service in that period, or (b) one hundred Canadian dollars (CAD $100). This limitation does not apply to any liability that cannot be limited under applicable law, including under Ontario consumer protection legislation, Quebec consumer protection legislation, or the Civil Code of Québec (for example, liability for gross or intentional fault).
13. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or damage, including reasonable legal fees, made by any third party and arising out of (a) your use of the Service, (b) Your Content, or (c) your breach of these Terms or of any applicable law. This section does not require you to indemnify us for our own negligence or wilful misconduct, or to the extent that doing so would not be enforceable under applicable law.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and, when practical, let you know in the app or by email. Your continued use of the Service after the update means you accept the new Terms. If you do not accept them, stop using the Service and ask us to close your account.
15. Governing law
These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in Ontario, without regard to conflict-of-laws rules.
16. Dispute resolution and venue
Before starting any formal legal action, you agree to first contact us at contactlinhttran@gmail.com and try to resolve the dispute informally. If the dispute cannot be resolved within sixty (60) days, either of us may pursue it in court.
Subject to any mandatory rights you have as a consumer under applicable law (including the right to bring an action in your local court under the Ontario Consumer Protection Act, 2002), you and we agree that the courts located in Ontario, Canada have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to the personal jurisdiction of those courts.
Quebec residents. Nothing in sections 15 or 16 limits your rights as a Quebec consumer. In particular, under Article 3149 of the Civil Code of Québec, you may bring any action arising from these Terms or the Service in the courts of Quebec, and the mandatory protections of Quebec consumer legislation continue to apply to you regardless of the choice of law above.
17. Export and sanctions
You agree not to use the Service in violation of Canadian export control or economic sanctions laws, and you confirm that you are not located in, under the control of, or a resident of any country or on any list that would prohibit us from providing the Service to you under those laws.
18. Entire agreement and severability
These Terms, together with our Privacy Policy, make up the entire agreement between you and us about the Service, and replace any prior agreements on the same subject.
If any part of these Terms is held to be invalid or unenforceable, the rest will continue in full effect. Our failure to enforce any right under these Terms is not a waiver of that right.
19. Assignment
You may not transfer or assign your rights under these Terms without our prior written consent. We may transfer or assign our rights and obligations under these Terms, for example as part of a sale, merger, or reorganization, as long as the new owner agrees to honour these Terms.
